Updates to the Notice of Privacy Practices

The purpose of this memo is to inform AIDS Drug Assistance Program (ADAP) Enrollment Workers (EWs) that the ADAP Notices of Privacy Practices has been updated. The ADAP Notice of Privacy Practices outlines how a client’s medical information may be used and disclosed and how a client can request their information. The most current notice must be posted in a visible location at each enrollment site.

The ADAP Notice of Practices has been updated to:

Clarify that the privacy practices also apply to ADAP’s business associates.
Include “personal facts” as a type of client information that may be shared for the operation of ADAP.
Clarify that the Secretary of the U.S. Department of Health and Human Services investigates or checks on how ADAP is meeting privacy laws.
Include that client information may be shared with the armed forces and authorized federal officials if deemed necessary.
Include a no discrimination clause.
Include the exception for clients requesting ADAP to restrict certain uses or sharing of their personal health care information.
Provide the current contact information for clients who would like to exercise their privacy rights or to file a complaint if they believe ADAP did not protect their privacy.
Provide the new policy for clients who would like to request a copy of the Notice of Privacy Practices.
Remove language regarding client information being sent to federal, state, and private entities for obtaining reimbursement for services as the payer of last resort, which may have created an explanation of benefits that could be sent to a primary policyholder who may not be an ADAP client (only applicable to the ADAP Notice of Privacy Practice).

Beginning March 17, 2025, previous versions of the ADAP Notices of Privacy Practices will not be used.
