Innovative Solutions for Complaints, Facility Reported Incidents, Waivers, and Program Flexibility

The California Department of Public Health (CDPH), Centralized Program Flex Unit (CPFU), and District Offices partnered with Risk and Safety Solutions (RSS) to automate both the survey and the complaint and facility reported incident (FRI) investigation process. CDPH will also centralize and automate the process for all facilities requesting program flexibility.  

All facilities will be able to submit an online program flexibility (PF) application.  Skilled nursing facilities (SNF) requesting Workforce Shortage Waivers (WSW) and Patient Needs Waivers (PNW) will also be able to submit an online application through RSS. The RSS application will be rolled out in phases, and will allow facilities to submit plans of correction and signed statements of deficiencies (CMS Form 2567) or waiver requests online directly to CDPH.

RSS is an online survey tool that allows CDPH to electronically collect and manage documentation of, and process, complaint and FRI investigations. The initial rollout will be for skilled nursing facility (SNF) complaint and FRI investigations.

If a complaint or FRI intake will be processed via RSS, the point(s)-of-contact at the SNF will receive an email invitation stating, "CDPH has invited you to create an account."  Thereafter, the point(s)-of-contact at the SNF can follow the instructions listed on All Facilities Letter 21-55 to create an account, locate an investigation or survey from CDPH in RSS, or to submit a plan of correction and/or signed CMS Form 2567.

RSS Application for Program Flexibility requests:

Registration for all facility types begins on January 18, 2022 based on the roll out schedule below.  Once registered, facilities can submit program flexibility requests to CDPH in accordance with the roll out schedule.

CDPH will provide more information and registration instructions to facilities prior to each scheduled roll out date.

  • Facilities who have an approved program flexibility expiring in 2022 will be able to submit their application prior to the expiration date regardless of roll out schedule.
