The California Department of Public Health (CDPH) Center for Health Care Quality has prepared this FAQ to assist stakeholders with questions about the temporary waivers of specific requirements for home health agencies contained in AFL 20-72.1.

Services

Question:  With the expiration of the waiver, can nurse practitioners, clinical nurse specialists, and physician assistants order, certify, and recertify home health services?

Answer: Yes. Nurse practitioners, clinical nurse specialists, and physician assistants may continue to order, certify, and recertify home health services after the expiration of the AFL. Pursuant to California Code of Regulations (CCR) Title 22 section 74697(a)(4), home health services can be ordered by the attending physician, dentist, podiatrist, or other licensed and legally authorized practitioner within his or her scope of practice.

Supervision

Question: Can supervision of home health care personnel be conducted virtually?

Answer: No. Supervision of home health aide services must be provided in person at the patient's residence while care is being provided. Supervision must be conducted by the applicable professional identified in CCR Title 22 section 74709(a)(1) and at the frequency described in CCR Title 22 section 74709(a).
