Assembly Bill (AB) 941 ā€“ Exemption from Licensure for Tribal Clinics


ā€‹AUTHORITY:      Health and Safety Code section 1206


All Facilities Letter (AFL) Summary

This AFL notifies any clinic conducted, maintained, or operated by a federally recognized Indian tribe or tribal organization that it is exempt from licensure requirements regardless of location of the clinic.

Effective January 1, 2016, AB 941 (Chapter 502, Statutes of 2015) expands the existing tribal clinic licensure exemption to include clinics conducted, maintained, or operated by a federally recognized Indian tribe under contract with the United States pursuant to the Indian Self-Determination and Education Assistance Act, regardless of the location of the clinic. These clinics may still choose to apply for licensure as primary care clinics subject to regulation by the California Department of Public Health (CDPH).

The information in this AFL is a brief summary of the provisions of AB 941. Facilities are responsible for following all applicable laws. CDPHā€™s failure to expressly notify facilities of statutory or regulatory requirements does not relieve facilities of their responsibility for following all laws and regulations. Facilities should refer to the full text of all applicable sections of the Health and Safety Code.
