The purpose of this memo is to inform ADAP & Prexposure Prophylaxis Assistance Program (PrEP-AP) enrollment workers (EW) that effective March 13, 2025, the CDPH, Center for Infectious Diseases (CID), OA, ADAP/PrEP-AP has updated its income policy for clients whose income is verified with the Franchise Tax Board (FTB).
Background
The OA uses the United States Department of Health and Human Service's Federal Poverty Level (FPL) guidelines. Currently, if a client's income for the prior calendar year exceeds 600% of the FPL per the FTB list, then the ADAP/PrEP-AP Advisor conducts outreach to the EW to get updated income information to demonstrate that the client is currently within income limits. If another form of acceptable supporting documentation for proof of income is submitted (i.e., pay stubs) to demonstrate that the client is currently within income limits, the client may remain enrolled in ADAP/PrEP-AP. This has been allowed without limit, even if the client has appeared to be over income in subsequent years.
Program Updates
Effective immediately, clients who are consecutively over the income limits, based on the FTB match, will no longer be allowed to enroll until they appear to be within income limits, per the FTB match.
For example:
- Client enrolls in ADAP in 2024,
- the client is over income per FTB data for 2023,
- when it is found that they appear to be over income, the ADAP advisor reaches out to the EW and the client submits proof that they are within income limits in 2024, and
- the client remains in ADAP in 2024.
- If the client applies for ADAP in 2025, and FTB data confirms that the above client was within income in 2024 (the year where they submitted other income documentation to prove they were within income limits), they will be allowed to re-enroll in ADAP in 2025, assuming they still meet all eligibility requirements.
- If the client applies for ADAP in 2025, and it is found that they were over income in 2024 per FTB data (the year where they submitted other income documentation to prove they were within income limits), they will be disenrolled from ADAP and may not re-enroll until their FTB data shows that they are within income limits.
- If the client applies for ADAP/PrEP-AP in 2025, and it is found that they were over income in 2024 per FTB data (the year where they submitted other income documentation to prove they were within income limits), but they had a life changing event that puts them within income limits, they may be able to enroll into ADAP/PrEP-AP at the discretion of the ADAP Branch Chief or their designee. They must provide a justification explaining the life changing event that puts them within income limits and acceptable supporting documentation to substantiate the life changing event.
