Temporary Fluoroscopy Permit for Supervisors and Operators

On October 4, 2021, Assembly Bill (AB) 356​ was enacted, amending the Radiologic Technology Act (Section 107110 of the Health and Safety Code​). This bill authorized CDPH to issue to an eligible Physician and Surgeon (MD), Osteopathic Physician and Surgeon (DO), or a Doctor of Podiatric Medicine (DPM) a temporary permit to operate, or supervise the operation of, fluoroscopic x-ray equipment. This Temporary Fluoroscopy Permit (TFP) is issued one time only, is not renewable, and is valid for 12 months from the date of issuance. 

A TFP is subject to the California Health and Safety Code (HSC) § 107070​. (HSC § 107110(b)(4).) 

Per HSC § 107070, certificates and permits, including TFPs, issued pursuant to the Radiologic Technology Act (RT Act) (HSC § 27) may be denied, revoked, or suspended for reasons specified in that law and include, but are not limited to:

  • Knowingly making or signing a document relating to the practice of radiologic technology that falsely represents the existence or nonexistence of a state of facts. (HSC § 107070(d).)
  • Procuring a certificate or permit by fraud or misrepresentation or because of mistake. (HSC § 107070(j).)
  • Use of a designation implying certification as a radiologic technologist by one not so certified, holding a limited permit by one not so permitted, or authorization as a certified supervisor or operator by one not so authorized. (HSC § 107070(k).) 

CDPH has authority to levy civil penalties not to exceed $5,000 per day, per offense for violation of any provision of the RT Act, the Radiation Control Law (HSC § 114860 et seq.), or regulation adopted pursuant to those laws.​ (HSC §§ 107075 & 115220.)

CDPH is aware of individuals altering the issued TFP. Altering the TFP is deemed fraud, is strictly prohibited, and subjects the individual to disciplinary actions including but not limited to denial, suspension, or revocation of the TFP or any RT Act certificate or permit and levying of civil penalties.​
